Conveyancing is the 'act of transfer of title to property from one person to another'. In essence it is the legal process of buying and selling property.

Property conveyancing by law, must be done by a property solicitor or licensed conveyancer.

Solicitors normally practice all areas of law, including conveyancing. Essentially the conveyancer is acting on behalf of either the buyer or seller and representing their interests in the property purchase or sale. It is the conveyancing solicitors job is to ensure that the terms and conditions of the contract for sale are fair and reasonable and that all of the financial information is correct. The process for what they actually do differs as to whether they are acting for the buyer or the seller.

The seller's conveyancer will request a copy of the land registry entry for the property. They will then prepare a contract for sale, incorporating the land registry plan and details, before forwarding it to the buyers solicitor (or licensed conveyance).

The buyers conveyancing solicitor will apply for the searches from a variety of bodies including the local authority, and will assess the contract for sale that has been received from the seller's lawyer. If the buyer is borrowing money on a mortgage then the solicitor will need to receive a copy of the mortgage offer and be satisfied that the buyer has sufficient funds available to complete the purchase.

Once all of the queries have been resolved, the searches have been received, and proof of funds achieved, then both parties will be in a position to exchange contracts.

Please refer to our property purchase brochure which explains the steps involved in a conveyancing transaction.

Daragh and Joseph pioneered the introduction, into the West of Ireland, a fixed legal fee in respect of Residential Conveyancing matters responding to the needs of modern day clients who insist on transparency and value for money in seeking assistance from their solicitor.

We will help you to prepare your Will and give advice on what suits your requirements. To ensure your wishes are carried out, we will prepare your Will and advise you accordingly giving due consideration to your tax and family affairs.

The area of Medical Negligence is an area of litigation that is particularly stressful for clients. It is very often the case in Ireland that the taking of a medical negligence claim is the only way that the patient/client can learn precisely what went wrong with his/her treatment.

These claims are very complex and essentially the standard of proof is commonly based on what a reasonable doctor with their requisite knowledge and skills would or would not do. The outcome of the case will often depend on whether the action taken by the medical profession is deemed reasonable or unreasonable in the circumstances.

Therefore it is essential that you probably advised in what is a complex area of law. We at Hassett Considine Solicitors LLP have a combined experience of over twenty years of successful medical negligence claims. We believe that successful litigation leads to an improvement in standards across the medical profession.

The Medical Negligence department of Hassett Considine Solicitors LLP is headed by Daragh Hassett, founding Partner. Only the most experienced of experts are engaged on your behalf for the purposes of advising on the issue of "negligence" which is the key issue to be proved in these cases. Our panel of medical professionals have an excellent track record of giving evidence in cases in the Irish Courts.

We deal with cases that for example include the following areas:-

  • Cerebral Palsy Cases
  • Negligence in Accident & Emergency Departments.
  • Cancer Misdiagnosis.
  • Orthopaedic Negligence.
  • Surgical Errors.
  • Laparoscopy or Keyhole Surgery.
  • Cosmetic Surgery.
  • Neonatal Surgery.
  • Obstetric or Gynaecological Injuries

The consequences of negligence by a Doctor, Physician, Consultant, Nurse or any other medical professional can have a potential dire outcome for the patient and their family. Health professionals have a duty of care towards their patients. Invariably in Ireland if something goes wrong the medical profession tends to become very defensive at the outset. Therefore it is essential that the patient be properly advised at the outset. The statute of limitations in a medical negligence action has now been reduced from three years to two years from the date of knowledge of the medical misadventure event so it is important you contact us as soon as you can so we can start the process. If the claim is ultimately successful we find that all or most of the costs involved are discharged by the losing party.

You will have gathered that Medical Negligence law can be very complicated. Friends and relatives are always keen to offer advice which whilst well meaning is generally unhelpful and inaccurate. We can assure you that at Hassett Considine Solicitors LLP you will get a first class and efficient service.

The Criminal Law department at Hassett Considine Solicitors LLP is headed by Daragh Hassett, Partner. Daragh is one of the lead criminal defence practitioners in Ireland and has for over 25 years in practice defended criminal cases in the District Court, Circuit Court and the Central Criminal Court.

Members of the public have a perception that they may never have to interact with a Garda investigation. This is far from accurate as nowadays people from all walks of life can find themselves arrested or charged with a criminal offence. In Ireland every citizen is innocent until proven guilty and we pride ourselves on our vigorous representation before the courts.

We recognise that if a person has been arrested or is under investigation by the Gardaí or has been asked to attend at the Garda Station to make a statement that they don’t necessarily have the financial resources to pay for legal representation. Hassett Considine Solicitors LLP are happy to defend a case on a legal aid basis if it is appropriate. We deal with all criminal cases from minor road traffic offences to very serious criminal cases returned to the Central Criminal Court.

The firm are lead defence solicitors in relation to drink and drug driving matters. Daragh Hassett in particular has vast experience of successfully defending these matters. We are very often favoured with referrals from colleagues who don’t specialise in criminal law. It is a complex area of law where the odds are firmly stacked against the driver and where a successful prosecution by the Gardaí can lead to dire and life changing consequences for the driver.

In all criminal law matters it is vital that you would place your faith in the hands of solicitors with a proven track record and experience in the area.

Drink driving and drug driving is socially unacceptable in Ireland in this day and age. The drink driving legislation in place makes it a criminal offence. The drink drive sanctions are a mandatory disqualification, fine, endorsement and in certain cases for repeat offenders a prison sentence.

The reality is that people still drink and drive. Quite often they are very decent, hardworking people or will never again have any contact with the criminal courts. They have immediate regret when stopped by the Gardaí. There is a sudden realisation of the consequences of their actions which affects their family and also threatens livelihoods.

In Ireland the majority of people rely on their driving licence to travel to and from their work. The loss of a licence can be a huge inconvenience.

The natural reaction of clients is that of shame. They then contact the family Solicitor. Quite often Hassett Considine Solicitors LLP are sought out by clients and colleagues alike given our expertise over the years in dealing with drink driving cases. If you have been involved in a drink driving or drug driving incident and you need to obtain expert advice from a Solicitor experienced in the area of drink driving law to act on your behalf, call on Hassett Consisdine Solicitors LLP.

Daragh Hassett, founding Partner at Hassett Considine Solicitors LLP deals exclusively with drink and drug driving cases in the firm. He has been dealing with drink driving cases for close to twenty years and is a renowned expert in the drink drive area. He will in a practical manner, advise you on your best approach to the case.

The law that deals with drink and drug driving cases is very technical. The limits continue to be lowered all the time. Whilst there is no excuse for drink driving you are innocent until proven guilty.

Arbitration, a form of alternative dispute resolution (ADR), is a legal technique for the resolution of disputes outside the courts, where the parties to a dispute refer it to one or more persons (the "arbitrators", "arbiters" or "arbitral tribunal"), by whose decision (the "award") they agree to be bound. It is a settlement technique in which a third party reviews the case and imposes a decision that is legally binding for both sides.

Arbitration can be either voluntary or mandatory (although mandatory arbitration can only come from a statute or from a contract that is voluntarily entered into, where the parties agree to hold all disputes to arbitration, without knowing, specifically, what disputes will ever occur).

Hassett Considine Solicitors LLP have acted for clients in a wide variety of matters relating to Arbitration and in Joseph Considine they have a qualified Arbitrator who is experienced in the areas of contract law, property law, commercial and company law and is thus well placed to provide reasoned awards.
